Employment of foreigners, approval within 1 day - Employer must declare salary and working conditions

From 10 days to just one working day. This is the new deadline that the National Employment and Skills Agency will have available to grant approval for the employment of foreign citizens in Albania, according to a joint instruction from the Ministry of Economy and Innovation and the Ministry of Internal Affairs.
According to the instruction, AKPA must express in the electronic system with approval, request for documentation completion or rejection within one working day, after evaluating the application, contract or job offer and relevant documentation. The amendments also expand the categories of foreigners who go through this procedure.
In addition to employees and seasonal workers, the self-employed, cross-border workers, people coming for vocational training and domestic workers are also included, in addition to highly qualified employees, athletes, volunteers and intra-corporate transferees.
The application for the unique permit or its renewal is made through e-Albania and is addressed to the border and migration structure in the region where the foreigner will exercise the activity.
US citizens and their family members, non-EU Schengen area citizens, and citizens of Western Balkan countries will have a more direct approach. For them, the application is processed only by the local border and migration structure, while AKPA provides employment data electronically.
The instruction also establishes a standardized job offer form, which must state the gross monthly salary, working hours, overtime and their compensation, night work, days off, as well as whether the employer covers accommodation or food.
The employer must also declare that the foreign employee will not have less favorable conditions than an Albanian employee in the same position and that he will not pay fees or costs for the recruitment process, which must be covered by the employer.
