Equipment for military purposes is exempt from VAT - Investments over 500

Equipment and machinery imported for use in the military industry will be exempt from import Value Added Tax.

According to legal amendments published in the Official Gazette, now in force, the import of a list of machinery and equipment that are directly related to the investment, in order to implement investment contracts with a value equal to or greater than 500 million lek, by or on behalf of entities licensed by the state authority responsible for the defense industry, based on the law "On the regulation of the production, trade, research and development of weapons, ammunition, military equipment and technologies", for the exercise of licensed activities, including machinery and equipment necessary for the production of military goods and dual-use goods and technologies, will be exempt from VAT.

The customs authority cooperates with the Ministry of Defense to identify entities licensed by the state authority responsible for the defense industry pursuant to the law.

Licensed entities must submit the required documentation in order to benefit from this measure, which includes a copy of the valid license issued by the state authority responsible for the defense industry, according to the law of 2024 "On the regulation of the production, trade, research and development of weapons, ammunition, equipment and military technologies", of the entity on whose behalf the investment is made; A declaration confirming that the machinery and equipment being imported serve directly for the exercise of the activities of the licensed entity according to the above law; as well as an explanatory report on the relationship between the designated taxable person and the entity licensed by the state authority responsible for the defense industry according to the law in force. 

The list of goods excluded from import includes a range of products, including those used in construction, cast iron or steel items, hand tools, machinery, plant or laboratory equipment, vehicles, means of transport for goods, medical, surgical, dental or veterinary furniture, lighting, etc.
