Energy efficiency, fines for violators - Administrative measures up to 1.5 million lek for energy audits or ISO certification

Administrative measures for entities that do not implement obligations on energy management systems or energy audits. The new draft law "On Energy Efficiency", issued for public consultation by the Ministry of Infrastructure and Energy, provides for fines of up to 1.5 million lek for large energy consumers, local government units and data centers that do not meet the requirements set out in several articles of the document.
Thus, failure to comply with the obligations to conduct energy audits or certify the energy management system according to the ISO 50001 standard can be punished with a fine of up to 1 million lek. Also, legal entities, public or private, that are categorized as large energy consumers, as well as local government units are obliged to employ at least one energy manager. The energy manager is responsible for maintaining equipment that consumes any form of energy, improving and supervising energy use methods and performing other tasks for the rational use of energy in buildings and industry. Failure to comply with the obligation to employ an energy manager is also penalized with a fine of 1 million lek.
Higher fines are foreseen for certified audit experts, who, if they do not comply with professional criteria or conceal technical data, risk fines of up to 1.5 million lek, as well as revocation of the certificate for up to three years.
The draft law also imposes new obligations on data centers, which must prepare action plans and report energy saving measures to the responsible agency. Failure to comply with these obligations is accompanied by a fine of up to 1 million lek.
