No more birth in the US for citizenship - Trump signs executive orders, despite

US President Donald Trump signed two executive orders to limit birthright citizenship, once again challenging a provision of the US Constitution, even though the Supreme Court rejected his previous attempt.

Restricting the right to citizenship based on birth has been a top priority in the Republican president's crackdown on immigration, with the White House particularly targeting what it calls "birth tourism," in which pregnant foreigners travel to the U.S. to give birth.

After the June 30 Supreme Court setback, Trump called on Congress to act, but he opted for executive orders, which set policy but do not carry the same weight as laws passed by Congress. The Supreme Court had struck down as unconstitutional Trump's previous executive order, which targeted a broad range of immigrants in the country illegally or temporarily.

The administration argues that the new directive falls outside the scope of the Supreme Court's decision, as it seeks to reinterpret narrow historical exceptions to birthright citizenship and expand who is not eligible.

The Center for Immigration Studies, which supports lower immigration levels, estimated in a 2020 analysis that between 20,000 and 25,000 mothers came to the U.S. for birth tourism in a one-year period between 2016 and 2017. In 2025, there were 3.6 million births in the U.S.

Trump's new orders could face legal challenges. Experts said it was unclear what effect the executive orders might have had on the Supreme Court's ruling, while immigration advocates called it an attempt to sidestep the Supreme Court's ruling.
