New rules for social care - Municipalities take responsibility for emergency cases

More services at home and less dependence on residential centers. These are some of the changes envisaged in the new draft law on social care, which the Ministry of Health and Social Welfare has released for public consultation.
The draft expands support for the elderly, people with disabilities and families in need. Care can be provided in the home, through mobile units, but also remotely, by phone or digital platforms. For family members who care for a person in need every day, temporary support is also provided, to ease their burden.
Stronger rules are set for emergency cases. When a person's life, health or safety is in danger, the municipality must provide protection within 24 hours. If it does not have the necessary service, it must find it in another municipality and continue to pursue the case.
The new draft also changes the financing. Funds will be distributed according to the number and needs of beneficiaries, the level of vulnerability, the remoteness of the areas and real costs. A reference cost will be determined for each service, which will be updated according to the price index.
Categories that meet the criteria will receive the services free of charge, while other persons may be admitted, if there are vacancies, for a full or reduced fee, according to economic possibilities.
The draft law also provides for a gradual reduction in residential centers, review of complaints within 30 days, and fines of up to 500,000 lek for private providers who violate standards. However, the report does not estimate the cost of the reform nor the additional funds that municipalities may need for the new responsibilities.
