Albanian professionals towards the EU - New draft law aims at recognition of

Albanian professionals may have a clearer path to practicing their profession in European Union countries. The Ministry of Education has submitted for public consultation a new draft law that aims to align the Albanian system with European rules for the recognition of professional qualifications and the practice of regulated professions.

The initiative is directly linked to Albania's EU integration process and the obligations to approximate domestic legislation to the acquis communautaire. The focus is on creating a unified system through which professional qualifications acquired in Albania can be recognized in EU countries after accession, facilitating the movement and employment of professionals.

The draft law also provides clearer rules for the recognition of qualifications of professionals from EU countries, the European Economic Area and Switzerland, and defines how the requirements for access to and exercise of regulated professions in Albania will be assessed.

From doctors to architects, the seven professions with similar rules

An important part of the process is related to sectoral professions, for which Albania has already started to approximate the minimum training requirements with EU standards. These are doctors, nurses, dentists, veterinary surgeons, midwives, pharmacists and architects.

According to the draft law, although steps have been taken to approximate these professions, the full system of recognition of professional qualifications and the mechanism for assessing proportionality are not yet fully included in Albanian legislation.

What changes with the draft law?

The initiative aims to create a unified procedure for the recognition of professional qualifications, by more clearly defining the criteria and mechanisms to be used by the responsible institutions.

Another element is the proportionality test, which will serve as an assessment mechanism before adopting new rules that restrict access to or the exercise of a profession. The aim is for these restrictions to be justified, necessary and in line with European standards. The draft law also aims to fulfil Albania's commitments under regional agreements on the mutual recognition of professional qualifications, including agreements concluded within the framework of CEFTA.

Final goal: More mobilized Albanian professionals in the European market

Essentially, the changes aim to ensure that Albania has a legal framework aligned with that of the EU for regulated professions. According to the objectives of the draft law, this will create the conditions so that, upon Albania's accession to the European Union, Albanian professionals can benefit from the mechanisms of mutual recognition of qualifications and have greater opportunities to move and practice their profession in member countries.

The initiative comes following the findings of the screening process for Chapter 3, which highlighted the need for full transposition of European rules on the recognition of professional qualifications and the proportionality test.
