New rules for beach administration - Agreement with investors enters into force

The government's decision on the standard model of the agreement to be concluded between the National Coastal Agency and strategic investors for the use of seashores, lakes and rivers as beach resorts comes into force.

This agreement aims to ensure more regular administration of coastal public spaces and guarantee safety for vacationers.

The standard model defines the roles of the three parties involved in this process: the National Coastal Agency as the grantor of the right of use, the strategic investor as the user and the local self-government unit as the beneficiary of the revenue from the fee. The agreement stipulates that the beach area is provided for the exercise of the beach station activity, according to the surface area, coordinates and map approved by the Strategic Investment Committee.

The fee for the use of the space is determined by the relevant Municipal Council and is indexed annually based on the inflation rate, according to the official inflation of INSTAT. The invoice for the payment of the fee is sent to the user within October of each year and payment must be made within 30 days of its receipt, while in case of delay, interest on late payment is applied.

On the other hand, the user of the beach station has the right to use the space taken into use for the entire period of the contract and to make the necessary investments in the supporting infrastructure, after obtaining the relevant permits. He also has the right to enter into contracts with subcontractors for the provision of services.

However, the user must respect a series of obligations set out in the agreement, which include using the space only for the specified purpose, respecting safety and hygiene standards, and cooperating with public authorities for any checks or inspections. Beach resorts must employ beach lifeguards throughout the tourist season.

Meanwhile, punitive measures are foreseen for violations of the rules. Exercising activity outside the area specified in the contract is punished with a fine of 150 thousand lek, while failure to display safety requirements is punished with a fine of 50 thousand lek. Failure to maintain or pollute the beach area, violation of hygiene conditions or failure to respect safety standards are punished with fines of up to 200 thousand lek. The absence of a beach watchman is also punished with a fine of 200 thousand lek and in case of repetition, the financial measure is doubled. The income from these fines goes 100% to the state budget.

The agreement for the use of the seashore ends with the expiration of the term specified in the contract, but it can be terminated earlier in the event of an agreement between the parties, in the event of force majeure that makes the development of the activity impossible, or when the user fails to fulfill his contractual obligations.

This agreement aims to increase beach management standards in the country, guarantee the safety of vacationers, establish clear rules for beach management, and increase safety and quality standards of tourist services in the country.
