Priority PPPs, in intersectoral filter - Draft: Selection Committee to be established, institutions that can grant concessions expanded

Setting priorities and identifying concession or public-private partnership projects that merit specialized expertise will be done by a special committee.
The draft law "On Concessions and Public Private Partnerships", issued for public consultation, provides, among other things, for the establishment of the Project Selection Committee, as a collegial administrative body, chaired by the Minister of Economy and bringing together the ministers of Finance, Infrastructure, Energy, Urban Development and Environment. According to the accompanying report, the establishment of this body ensures a cross-sectoral filter before the launch of strategic projects.
The committee invites, on a case-by-case basis, without the right to vote, representatives from the academic world, as well as the heads of the contracting authority or entity, whose field of activity is the object of the concession/public private partnership project, to argue their request.
The draft also expands the range of contracting authorities, giving many institutions the right to conclude concession or PPP contracts. This is because the current law defines line ministries and local government units as contracting authorities. Meanwhile, according to the draft, this right will also be granted to constitutional institutions, such as the Parliament, the Presidency, the Constitutional Court, etc.; independent institutions such as the Ombudsman, the Supreme Audit Office, the Central Election Commission, the Albanian Association of Lawyers, etc.; other central institutions, such as ministries and state agencies, as well as local self-government units, which include municipalities and administrative units.
The law also provides for many other additions and changes, which according to the report aim to create a clear, sustainable and competitive framework for promoting private investment through concessions and public-private partnerships (PPP).
