3 new institutions for food safety are established - Control is strengthened.

From August 1, 2027, Albania will have a more robust control system for businesses that produce, import and trade food products in the country, significantly increasing food safety, as a condition for integration into the European Union.

The new draft law submitted for public consultation on "Official Controls" provides for the creation of 3 new institutions that will be responsible for this process. Specifically, the Institution Responsible for Conducting Official Control (IPKZ); the Institution Responsible for Conducting Other Activities (IPAT); the Institution Responsible for Conducting Official Control at Border Control Points (IPKPKK).

Specifically, the IPPC regularly carries out official controls on all operators, on a risk-based basis and with appropriate frequency, taking into account: the identified risks related to: animals and goods; activities under the control of operators; the location of the operators' activities or activity; the use of products, processes, materials or substances that may affect food safety, the integrity and quality of food, or the safety of feed, animal health or welfare, plant health or, in the case of GMOs and plant protection products, which may also have a negative impact on the environment.

Likewise, controls are undertaken when there is information indicating the possibility that consumers may be misled, particularly regarding the nature, identity, properties, composition, quantity, stability, country of origin or place of provenance, method of processing or production of food.

Official controls are carried out without prior notice, except where prior notice is necessary and justified. They focus on any business process, such as traceability, labelling, presentation, advertising and relevant packaging materials, including materials intended to come into contact with food. The draft sets out the methods used for sampling and for laboratory analyses, tests and diagnoses during official controls.

The new draft law also defines "salty" administrative measures against abuses that may be committed by entities. Specifically, fines range from 100-300 thousand lekë, in cases where access to equipment, means of transport, premises and other places under the control of the business operator is not provided, computer systems, animals and goods, documents and other relevant information.

As well as the maximum of 1-2 million lek, in cases where the entity carries out the activity in an unregistered or unapproved unit.
