The polluter will pay for environmental rehabilitation/ Operators will also bear the costs for on-site inspections
Operators responsible for environmental damage will have to take measures to restore damaged forests, habitats, waters or land and bear the costs associated with rehabilitation. The Ministry of Environment has approved two new orders that determine the measures to be taken, as well as the method of calculating the costs for eliminating environmental threats and damage.
According to the new rules, rehabilitation is not limited to intervention in the damaged area. It is divided into primary, supplementary and compensatory rehabilitation.
In parallel, the Ministry has approved a method for calculating costs, which is explicitly based on the “polluter pays” principle. The bill that can be charged to the operator includes not only the costs of rehabilitation, but also field inspections, sampling, laboratory analyses, scientific studies, experts, monitoring and administrative expenses.
The method also provides for the recovery of the costs of emergency measures, primary, complementary and compensatory rehabilitation, monitoring, as well as legal and judicial costs directly related to the implementation of environmental liability. The costs will be determined on the basis of actual costs, market prices, expert assessments or standard cost rates.
The National Environmental Agency is the institution responsible for implementing the measures. However, their practical implementation will begin after the approval and entry into force of other sub-legal acts on environmental liability, as provided for by the Environmental Protection Law.
