Hospital waste management - New requirements for those who generate it, fines

The Ministry of Environment and Health has issued for public consultation a draft decision that aims to create a clear and enforceable framework for hospital waste management.

According to the accompanying report, it focuses on improving waste management practices produced by healthcare institutions, which pose a high risk to medical staff, patients and the community in general if not treated safely.

The document sets out the standards that all hospital waste producers in the country must follow, including source separation, temporary storage, differentiated collection, packaging, labeling, treatment and disposal of waste, following the principles of the waste management hierarchy and the circular economy.

The draft decision, which was also drafted in implementation of Article 35 of the Law "On Integrated Waste Management", aims to establish clear responsibilities for waste producers and collectors, helping them to respect legal obligations and apply high safety and hygiene standards.

Meanwhile, violations of the requirements will constitute administrative offenses and will be punished according to the legislation in force. The measures include sanctions proportionate to the nature of the violation, designed to prevent repetition, and may lead to the temporary or permanent suspension of the activity, or even the revocation of the relevant licenses and permits.

These measures will be implemented by the structures responsible for inspection in the fields of environment and health, according to their respective competencies.
