Official holidays, how are overtime hours paid at work? - Compensation with time

Domestic employees who are required to work more hours than 8 hours per day or 40 hours per week, as well as on days that coincide with official holidays, are entitled to additional pay.

Article 90 of the Labor Code provides that the maximum number of overtime hours is determined in the collective agreement or individual labor contract.

The employer may require additional working hours, but not more than 200 hours per year.

The employer, in agreement with the employee, may compensate for overtime hours with a leave of at least 25 percent longer, corresponding to the duration of the overtime hours and granted within 2 months from the day the work was performed, except in cases where otherwise provided for in the collective agreement.

For additional hours of work that are not compensated with time off, the employer must pay the employee the normal salary and a supplement of no less than 25 percent of it, except in cases where otherwise provided in the collective agreement.

Overtime hours worked during the weekly rest period or on official holidays are compensated with time off or a salary at least 50 percent higher than the overtime hours worked or the normal salary, except in cases where otherwise provided for in the collective agreement.

Overtime cannot be required when the employee has worked 48 hours per week. In special cases, for a period of up to 4 months, more than 48 hours per week may be worked, but the average weekly working time for this period must not exceed 48 hours. Overtime is calculated on the employee's gross salary.
