Businesses have increased awareness regarding the legal consequences of illegally employing individuals.
From the statistical data reflected in the annual report of the Prosecutor General, a decreasing trend is observed in the proceedings registered for the criminal offense of "Illegal employment".
Thus, in 2024, 18 criminal proceedings were registered compared to 20 criminal proceedings registered in 2023, or a decrease of 10%.
If we analyze the figures in the last 5 years, it is noted that the highest number of proceedings is in 2021 with 39, and then there has been a progressive decline.
The specific weight of this criminal offense in the group of criminal offenses "Criminal offenses committed in commercial companies" in 2024 is 66.6%, while in 2023 it was 64.5%.
In recent years, the State Labor Inspectorate has increased the number of inspections of entities, based on risk, where one of the objectives is illegal employment by companies, and the referral of cases to the prosecutor's office. Illegal employment includes the employment of minors but also of adults who are not declared to the tax authorities as employees.
On the other hand, the tax administration has undertaken a broad anti-informatization campaign, which has significantly increased the awareness of businesses in this regard, with the aim of avoiding penal measures under the legislation in force.
