Electricity licensing expanded - Storage, aggregation and charging points included. Here's who is exempt from the obligation

The proposed amendments to the law "On the Electricity Sector" provide for the expansion of activities related to licensing and supervision by the Energy Regulatory Authority.
The changes aim to adapt the legal framework to new developments in the market, including energy storage, aggregation and the operation of charging points for electric vehicles.
According to the draft, the operation of electricity storage facilities is added to the list of activities requiring a license. Meanwhile, the ERE will have the right to decide whether to license new activities such as the operation of charging points and aggregation.
The draft also provides for relief for several categories of operators. Operators of storage systems with a capacity of up to 1 MW will not be required to obtain a license. Likewise, a supply license will not be required in cases of resale or distribution of electricity, but these activities will be carried out on the basis of conditions and maximum prices that will be determined by the ERE.
Another change is related to terminology, where "self-producers" are replaced with the broader concept of "active customers", in line with energy market developments.
According to the accompanying report, the changes reflect the expansion of the functions of the energy market and aim to create a more flexible framework for new activities, while simultaneously guaranteeing supervision and regulation by the ERE.
Meanwhile, the secondary legislation is expected to detail the conditions and procedures for licensing these activities, as well as the criteria for operating without a license in certain cases.
