State Intelligence Service, law changes: Collects information on threats to economic security

The Council of Ministers has approved the amendments to the law “On the National Intelligence Service” and has submitted them for approval to the Albanian Parliament. What is striking about the relevant draft law is that in addition to the name update from “National Intelligence Service” to “State Intelligence Service”, Article 2 expands the tasks of collecting information and also includes economic security, cybersecurity and threats to critical infrastructure.

SOME AMENDMENTS AND ADDITIONS TO LAW NO. 8391, DATED 28.10.1998, “ON THE NATIONAL INTELLIGENCE SERVICE”, AS AMENDED
In accordance with Articles 78, 81, point 1, and 83, point 1, of the Constitution, upon the proposal of the Council of Ministers, the Assembly of the Republic of Albania
DECIDED:
In Law No. 8391 dated 28.10.1998, "On the National Intelligence Service", as amended, the following changes and additions are made:
Article 1
1. The title of the law is amended and replaced with "On the State Intelligence Service".
2. These changes are made throughout the content of the law;
a) The name “National Intelligence Service” is replaced by “State Intelligence Service”;
b) The abbreviation “SHIK” is replaced by “SHISH”;
c) The name “Permanent Parliamentary Subcommittee” is replaced by the words “… committee responsible for security …”;
ç) The words “… national security …” are replaced by “… national security …”;
d) The words “… national security …” are replaced by “… national security …”.
Article 2
In the first paragraph of Article 3, the following amendments and additions are made:
1. The first three subsections are amended as follows:
“- Collects information inside and outside the country in function of national security, collective security and global challenges.
– Collects information on threats arising from the activity of foreign intelligence services, in all forms that it expresses and appears, in function of preserving integrity, independence and constitutional order.
– Collects information on terrorism and extremism, crimes against the environment, the production and proliferation of weapons of mass destruction, as well as on internal and regional stability.”
2. After the third subdivision, two subdivisions are added, with the following content:
“- Collects information on threats to economic security, cyber threats and hybrid threats, with an impact on the country's security environment.
– Collects information on threats to the critical and important infrastructure of the Republic of Albania.”
Article 3
The following changes and additions are made to Article 5:
1. The last subdivision of the third paragraph is repealed.
2. At the end of the article, two paragraphs are added, with the following content:
"The Director and Deputy Director of SHISH benefit from a basic salary, a seniority supplement and a supplement for a special nature of work. Their financial treatment is determined by a decision of the Council of Ministers.
The Director and Deputy Director are treated by the legislation on supplementary state pensions for persons performing constitutional functions and state employees."
Article 4
In the last paragraph of Article 6, and in the first paragraph of Article 7, the word "People" is deleted.
Article 5
The following additions are made to Article 10:
1. At the end of the first paragraph, after the words “… of the personnel …”, the words “…, as well as from the obligations arising from the law on the right to information.” are added.
2. After the first paragraph, the following paragraph is added:
"SHISH employees are exempt from the obligation to declare income derived from salary, as well as the declaration and control of assets, financial obligations of elected officials and some public servants. Their annual control is carried out by the special structure in the State Intelligence Service, according to the procedures determined by an internal act of the SHISH director."
Article 6
At the end of Article 13, a paragraph is added, with the following content:
"SHISH has the right to access state databases, which is limited according to legal function and regulated by inter-institutional agreement."
Article 7
Issuance of sub-legal acts
The Council of Ministers and the Director of the State Intelligence Service are hereby instructed to, within 3 months from the entry into force of this law, adopt the sub-legal acts for its implementation.
Article 8
Entry into force
This law enters into force 15 days after its publication in the "Official Gazette".

DECIDED:
The draft law proposal "On some amendments and additions to law no. 8391, dated 28.10.1998, "On the National Intelligence Service", as amended", for review and approval in the Assembly of the Republic of Albania, according to the text and report attached to this decision.
This decision takes effect immediately.
