Mobile and internet services, with new security rules - AKEP: Independent audits for companies with over 100 million lek in annual revenue

AKEP requires that all companies that provide telephone and internet services to the public take detailed measures to protect their networks and user data from cyberattacks and technical problems.
The Electronic and Postal Communications Authority has published for public consultation a new regulation that aims to increase the security of telephone and internet networks in Albania.
The regulation establishes new rules for companies that provide communication services to the public. The aim is to prevent service disruptions and protect users' personal data.
Companies are required to take technical and organizational measures to prevent cyberattacks, technical defects, and any incidents that could affect users. They must have security plans, train staff, and regularly check their systems.
In the event of an incident, companies must notify AKEP within 24 hours and inform users if there is a risk to their data. The regulation also defines the reporting format and the method of assessing the impact of incidents, using a special table that classifies the impact as low, medium or high.
Companies with annual revenues of over 100 million lek may be required to conduct independent safety audits. If AKEP finds deficiencies, it may impose mandatory improvement measures, setting concrete deadlines for their implementation.
The regulation also includes measures to protect personal data, as well as the obligation to inform users in the event of a privacy breach. Companies must publish instructions for users on their official websites, have a person responsible for security, and keep a record of any incidents.
If companies do not comply with the rules, they may face fines and other administrative measures, according to the law on electronic communications.
