"Online transparency and security increase" - Karakaçi: The new law fills the legal gap for digital services

More transparency for advertisements that appear on social networks, complaint mechanisms for blocked accounts and stronger measures against illegal content. These are some of the rules that are expected to be imposed on online platforms through the new draft law “On Digital Services”, which has been submitted for public consultation. The Minister of Infrastructure and Energy, Enea Karakaçi, said that the development of technology and the use of artificial intelligence require the adaptation of the legal framework.
“Digital services and digital developments are a tangible reality, and the use of digital tools, including artificial intelligence, are part of our daily lives. Advanced developments, digital transformation also require the adaptation of a contemporary legal framework, such as the one we propose to you. Comprehensive that promotes both innovative developments, but that guarantees respect for fundamental rights, and the principle of consumer protection. The draft law “On Digital Services”, which is already in public consultation and any of you, or interest group has the right to provide comments, aims to contribute to the proper functioning of intermediary services in the Republic of Albania. By establishing harmonized rules for a secure, predictable and reliable online environment, that responds to technological developments, and online services. By ensuring the protection of fundamental rights and better consumer protection.”
The draft law, according to the minister, aims to fill current gaps in the regulation of online services and will be sent to the European Commission for evaluation.
“Like any other initiative within the framework of European integration, it will be sent to the European Commission for assessment and will proceed with its approval only after the European Commission gives its consent and agreement for the approval. The draft law certainly addresses the issues related to the lack of a specific framework for the regulation of digital services, the lack of harmonized obligations for online platforms, as well as the need for more effective mechanisms for transparency, the protection of users, their personal data and the treatment of illegal content on these platforms. Positive effects are expected in the legal, institutional and economic aspects, by improving online security and reliability standards, increasing user protection, promoting the development of the digital economy and a more reliable and competitive digital market, as well as contributing to the advancement of the European integration process of the Republic of Albania.”
The implementation of the law will be overseen by the Digital Services Coordinator, a new authority that will cooperate with Albanian and European Union institutions.
