Government reinforces cannabis cultivation criteria - Monitoring in the EU, what are the transport and export procedures?
"In order to cultivate areas with cannabis sativa for medicinal purposes, the Albanian government has adopted strong criteria and rules, starting from the safety method of cultivation to the procedures for moving the means of transportation of the raw materials needed for this purpose. But how is the monitoring of the premises defined?"
Referring to the Decision of the Council of Ministers, the premises must be continuously monitored with a CCTV camera system equipped with a built-in reader and motion sensors, with high resolution, with infrared rays, including the space 20 meters outside the perimeter, which it should be lit.
The film images of the camera servers must be stored for at least 60 days and at least for a period of 1 year in storage located in one of the EU countries. The camera system monitors the surface, inside and outside the premises of the production unit.
The surface where the activity is carried out is guarded 24 hours a day without interruption by the entity in charge of physical security and security, which includes a response service with a signal verification group. Meanwhile, in cases where cultivation is carried out in closed premises, the external wall must be stable, while in case of cultivation in open or protected premises, it is surrounded from the outside with a stable wall with a height of 4 m from the ground.
"But to stop the transport of the plant, its by-products and products must be carried out with closed means that ensure that they are not visible or identifiable from the outside of the vehicle and must be accompanied by the relevant record for the quantity and type of the product being transported. And they must be done with means that ensure their preservation in optimal conditions according to the request of the host country. In the meantime, the subject must ensure that the transport vehicle is closed, sealed and equipped with GPS in order to continuously monitor the movement from origin to destination and have cameras that monitor the material being transported, as well as being stored and accompanied from the security service to/from the border crossing point, according to the provisions in the agreement concluded between the parties. Any movement or transport is carried out only after receiving authorization from the Agency, which approves the proposed date of movement or transport, according to the format approved by the latter."
For export customs procedures, after the security checks are carried out at the border customs offices of the exit from the customs territory of the Republic of Albania, these procedures can start at the internal customs offices competent for the territory where the cultivation premises are located and end at the customs offices border exit from the territory. The authorized entity is obliged to notify the General Directorate of Customs at least 5 days before the import/export customs procedure.
