Public Procurement, 122 complaints in July - PPC reviews them on average for 34 days

122 complaints were registered during the month of July with the Public Procurement Commission. Most of them are related to procurement procedures for goods and services, while the rest are related to public works. According to the PPC data, out of the 122 complaints filed, 74 were filed during the bid evaluation phase, 47 are related to tender documents, while one complaint is classified in other categories.
In terms of contract type, 69 complaints related to procedures for goods, 34 to services and 19 to public works. Of the total number of complaints, 101 were for single procurement procedures. For these procedures, 73 complaints were below the upper monetary threshold, while 28 were above this threshold. The data also show a significant difference in the time of examination, depending on the contracting authority.
In total, 4 substantive decisions were taken during the month, through which 4 complaints submitted by economic operators were reviewed and resolved. From the decision-making, one case was accepted, two were not accepted and another was closed. The financial side of the complaint process is also reflected in the balance of the month.
In July, the KPP collected 21 million and 786 thousand lek in financial fees as guarantees for procurement procedures. Meanwhile, about 9 million and 842 thousand lek were returned to economic operators at the end of the review, while 469 thousand lek are expected to be paid to the State Budget.
The Public Procurement Commission has also addressed interpretative issues related to tax and social security obligations, economic operator licenses and abnormally low bids in July. According to the PPC, the decisions aim to provide guidance to contracting authorities and economic operators in the application of qualification and evaluation criteria in public procurement procedures.
