Privacy, how will biometric and genetic data be treated? - Commissioner

The protection of personal data in justice and public security institutions, as well as the role of the Personal Data Protection Officer, were the focus of the awareness-raising activity organized by the Office of the Commissioner for the Right to Information and Personal Data Protection, with the participation of representatives of the justice and public security system.

Commissioner Dervishi underlined that the protection of personal data should not be seen as an obstacle for law enforcement institutions, but as a democratic standard that increases public trust in institutions.

“The use of personal data for the prevention, investigation or prosecution of criminal matters must always be based on law, proportionate and necessary for the respective purpose. Law 124 of 2024 on the protection of personal data establishes the following principles: Lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy. These are not only procedural requirements, but are real guarantees for citizens and professional standards for public administration. Of particular importance is the treatment of special categories of personal data, such as biometric, genetic data, or other sensitive data, which require increased security measures and stronger protection of individual rights. The Office of the Commissioner is a supervisory institution, guarantor of fundamental rights, national security institution and institutional partner in strengthening the culture of personal data protection. In function of the new law, the Office of the Commissioner exercises extended supervisory and investigative powers, conducts inspections, verifies compliance with the law, requires corrective measures and imposes administrative measures. Also important is the advisory and educational role, which the Commissioner's Office strives to implement and cultivate.”

The Commissioner's Office reiterated its commitment to supporting public institutions in the implementation of the new legislation on the protection of personal data, in order to guarantee the fundamental rights of citizens and strengthen the rule of law.
