A significant change in the way the state administers confiscated assets is expected to come through a new draft law, which aims to centralize powers under the Agency for the Administration of Sequestered and Confiscated Assets (AAPSK). According to the explanatory report, the division of powers between the Commission for Confiscated Objects, the responsible ministry and the implementation units has led to delays, overlapping functions and difficulties in managing the objects.

The draft law provides that the AAPSK will be the sole body responsible for the administration and development of objects with “confiscated” status. As part of the reorganization, the abolition of the Commission for Confiscated Objects is also proposed. Instead of structures that were created in various ways depending on the case, the creation of a permanent technical working group is envisaged. According to the government, this will avoid institutional clashes and will more clearly define responsibility for each stage of the process.

Another proposed change is the creation of a transparent and public registry of confiscated objects. The aim is for institutions, but also interested entities, to have information and a clear point of reference for assets that can be used, developed, leased or sold. The draft law also aims to facilitate procedures for the evaluation of objects and the provision of development and construction permits.

A problem identified by the implementation of the current legislation is related to the financing and completion of unfinished buildings. For this reason, it is proposed to create a special/dedicated fund, including the financing of confiscated illegal constructions. According to the report, the new mechanism aims to avoid situations where confiscated property remains unused for a long time, losing value due to depreciation.

The ultimate goal is to return illegally acquired assets to the community as quickly as possible. This can be achieved through institutional or social use, leasing or sale, depending on the nature and potential of each object.
