"Fiscal Package, the last chance for debtors" - Malaj: It is not an amnesty. Let's close the chapter on old, prescribed debts

With the draft law on the forgiveness of tax and customs duties, we close the chapter on old, prescribed debts. This was stated by the Minister of Finance Petrit Malaj during the plenary session for the review of the draft law "On the 2026 budget", who emphasized once again that the Fiscal Package does not foresee any tax increases, while guaranteeing a transparent fiscal framework.
"The two most important draft laws are the draft law on the peace agreement and the draft law on the forgiveness of tax and customs obligations. We are not undertaking an Amnesty. Through the "Fiscal Peace", we do not forgive any criminal liability. We do not guarantee immunity for anyone and above all we do not serve anyone who is under investigation or in judicial proceedings. Also, with the draft law on the forgiveness of tax and customs obligations, we close the chapter on old, prescribed debts. The Fiscal Peace Agreement, which will be implemented for the period 2026-2028, aims to correct and increase regular declarations for businesses that want to be included in this voluntary agreement", said the Minister.
The Fiscal Package is designed according to the same model that was implemented in Italy in 2018. According to Malaj, the draft law on the forgiveness of tax and customs duties is the last chance they give to debtors.
"The draft law on the forgiveness of tax and customs duties provides for the complete cancellation of any debt that is older than 10 years. For debts with an age of 5-10 years, the possibility is offered that, taking into account the financial situation, against a payment of the tax obligation in the amount of 50% or 75%, the business will have the rest of the debt forgiven, as well as fines and late payment interest; while for debts with an age of 0 to 5 years, fines and late payment interest will be forgiven, against the payment of 100% of the tax obligation. (payment within 31/12/2026). I reiterate once again that with this draft law, we do not foresee forgiving the unpaid obligations of tax evaders who are under criminal prosecution, against those against whom a tax investigation has been initiated, or for businesses that have a final decision from the courts. Therefore "This is the last chance we give debtors, before the austerity measures for collecting tax liabilities come into effect ," said Malaj.
The Fiscal Package includes for the first time the VAT compensation scheme. Farmers will be compensated at a rate of 10% of the value of the sales invoices of their goods to the collector, processor and/or agribusiness.
