KPP canceled 52 tenders for irregularities - Decisions, after complaints about the criteria or evaluation of the winner
During 2024, the Public Procurement Commission canceled 52 tenders due to irregularities committed by state institutions. The drastic decisions came after complaints filed by economic operators and after the finding of numerous violations.
Unclear and confusing criteria, which have influenced the preparation of economic offers by economic operators, is one of the violations found.
Also, the reasons for the cancellation of tender procedures have been criteria that were drafted in violation of the public procurement law and other sectoral laws or actions of the contracting authority during the bid evaluation process, which have led to an unfair classification.
Also, irregularities were found during the process of administering the samples submitted by the economic operators or irregularities in the process of administering the documentation submitted by the first ranked economic operator.
According to the data, 23 procurement procedures were canceled due to the drafting of tender documents, while another 29 were canceled due to complaints filed at the stage of objecting to the evaluation conducted by the contracting authority.
During 2024, 7168 unique procedures were published in the Electronic Procurement System, for public procurements with a total value of around 330 billion lek.
Meanwhile, a total of 1151 complaints were submitted by various economic operators last year. At the national level, 11.5% of the unique procurement procedures above the small purchases limit and 9.9% of the published procedures limit fund were appealed.
