The process of legalizing property in Albania is expected to be completed in 2028, which coincides with the date on which Albania intends to sign the Accession Treaty with the European Union. The objective is for all properties to be “regularized” before EU membership. From the merger of the State Cadastre Agency and the Property Treatment Agency into a single agency, to the “door-to-door” control of all properties that have been built without a permit, the government has drafted 3 draft laws that are expected to end the years-old unresolved property “impasse”.

The draft laws regulate the process of administration, registration or transfer of properties. In order to respect the established deadline, it is envisaged that the procedures will be accelerated and the decision will be taken within 30 days, against the payment of an additional fee.

Consolidating the rules into a single legal framework will make them clearer for the institutions that implement them and for the citizens themselves. At the same time, it will achieve respect for the principle of legal certainty, as the basis of the rule of law. Legal certainty has as a necessary requirement the fact that the law as a whole, its parts or specific provisions, must be clear, defined and understandable.

These amendments do not concern the harmonization of Albanian legislation with the European Union, as the latter does not have directly binding legislation for member states regarding the legal regime of property or the organization of cadastral systems. Property issues remain largely within the domestic competence of states and the EU does not intervene. However, the draft laws stipulate the respect of some European standards and practices.

Uncertainty over property titles and incomplete property registration remain factors that hinder investment. If Albania improves registration, property titles, and legal certainty, this could make the market more attractive to investors. This could create upward pressure on prices in areas with high demand.

Also, the country's EU membership is expected to increase demand and interest in properties. According to experts, this could lead to a gradual price increase of 20-40% over a period of 5-7 years for areas with clear property titles, clean air, good transport links and well-maintained infrastructure. However, the effect is not automatic and will not be the same across Albania.
