Export of military goods - Ministry of Defense extends validity of licenses from one to two years
Any export of military and dual-use goods is subject to a license and a risk assessment. The Ministry of Defense has decided to extend the validity of licenses from one year to two years for the export of these goods.
A draft law has been published for public consultation regarding several additions and amendments to the law on state control of international transfers of military goods and dual-use items and technologies.
The existing law did not contain sufficient provisions for goods that are not listed, but that could be used for the development or proliferation of prohibited weapons. Regarding the granting of licenses, some EU criteria have been added, in order to align Albanian practices with those of the Member States.
Dual-use goods include computer software and technology that can be used for both civilian and military purposes, and include goods that can be used for the design or use of nuclear, chemical or biological weapons or their means of delivery.
For the first time, unlisted goods for cyber surveillance will be controlled if they are used for internal repression or human rights violations. So, for the first time, we have control of those goods that are related to the covert surveillance of individuals via telephone or other electronic devices.
On the other hand, the novelty is the inclusion of eight EU criteria for assessing licensing requirements. The criteria include respect for international obligations, human rights, the internal situation in the country of destination, regional stability, national security, the international conduct of the host country, the risk of diversion and the economic suitability of the export.
The State Export Control Authority issues individual, global or general licenses for the export of dual-use items. These changes come within the framework of the approximation of Albanian legislation with that of the European Union.
