Businesses, obligation to declare every job vacancy - Draft/ Salary per position

Businesses in the country, as well as public institutions, will face new and stricter labor market regulations.

The draft law submitted for public consultation on several additions and amendments to the law on the promotion of employment aims to regulate relations in the labor market and promote the adjustment between supply and demand. Thus, referring to the changes, every employer will have the duty to announce or notify the institution responsible for employment and skills, paid job vacancies through declaration in the relevant regional/local employment structures. In each job vacancy announcement, the employer must make public the salary range for the advertised position.

Also, every employer has an obligation to declare and update data related to the employee's employment relationship.

On the other hand, any employer who dismisses an employee is obliged to declare the dismissal of the employee according to legal provisions and this information is also forwarded to the relevant employment office according to the employee's place of residence. The declared information, including the reason for the dismissal and the employee's contact information, is automatically forwarded to the institution responsible for employment.

If employers fail to make the relevant declarations, they will face fines according to applicable legislation.

The draft also provides for the creation of the Digital Employment and Skills Passport as a national instrument for documenting, administering and verifying information on an individual's employment history, profession, qualifications, skills and professional experience.

It is also envisaged to create a legal basis for the functioning of the Labor Market and Skills Observatory as an integrated national mechanism for the collection, exchange, processing, analysis and dissemination of information on the labor market and skills development.

Through the changes, the aim is to expand the categories included in the Sovereign Guarantee Scheme, including for the first time the category of "student worker", in support of the development of education and vocational training in the dual form; the concept of job seeker is expanded to include Albanian citizens residing outside the Republic of Albania, creating greater opportunities for the inclusion of the diaspora in employment services and programs, and providing more access to foreign citizens who enter, reside or intend to reside legally in Albania for employment purposes.
