2-fold increase in fines for greenhouse gases - Industrial and transport

Doubling of fines for entities that violate legal obligations on monitoring and reporting greenhouse gases. Everything is foreseen in the new law "On Climate Change", according to which installation operators, regulated entities, as well as air and maritime transport companies, that exercise activity without authorization or without an approved monitoring plan, will be punished with fines ranging from 2 million to 4 million lek. This level is twice as high compared to the current fines, which fluctuate between 1 and 2 million lek.

The fine will increase by 2% of the value each day until the violation is corrected. Penalties will also be applied for failure to report greenhouse gas emissions data or for failure to notify changes that require an update of the environmental permit.

The amendments also impose clear legal obligations on companies that produce, transport or use fuels, as well as other sectors such as aviation or maritime transport. These entities will be obliged to accurately monitor and report greenhouse gas emissions, while the reports will be verified by accredited auditors and submitted to the National Environment Agency.

The changes affect a wide range of industrial activities with high greenhouse gas emissions, some of which were already required to monitor their emissions, but now this process will be carried out through the MRVA (Monitoring, Reporting, Verification and Accreditation) system, in accordance with European Union standards.
