The application and reporting procedure for the revaluation of real estate with the 5% tax rate will not be the same for all citizens. Its complexity is related to the fact that a property is located in an area where the initial registration of properties has been carried out or not and whether or not it enjoys the title of ownership.

Specifically, what does the instruction provide?

When the immovable property, subject to revaluation, is registered in the cadastral registers and is located in an area that has undergone the initial registration process, the reflection of the revaluation of the property is carried out in section “A” of the property card. In this section, the date of the revaluation of the immovable property, the revaluation amount will be recorded and the documentation will be archived in the relevant reference.

But the situation changes when it comes to an immovable property, subject to revaluation, located in an area that has undergone initial registration, but which is not registered in the cadastral register.

In this case, the individual must first apply through the unique government portal e-Albania for the registration of this property, in accordance with the provisions of the 2018 law, “On the Cadastre”, and the 2020 government decision, “On the approval of the list and fees of cadastral services”, as amended, by submitting the title of ownership and supporting documentation for registration. Only after registering this property in the cadastral register, does the subject have the right to apply for the revaluation of this property.

On the other hand, when the real estate subject to revaluation is located in a cadastral area that has not been subject to the initial registration process, the revaluation value is recorded in the relevant mortgage register or in the non-final cards, reflecting the date of the revaluation of the real estate, the relevant revaluation amount and the relevant archival reference.

At the end of the initial registration process, the above revaluation notes are reflected in the real estate cards, a product of this process, in cases where the ownership title is found to be in accordance with the law.

But in cases where the registration of the ownership title is refused, according to the law in force and the individual does not become its legal owner, the revaluation value is not reflected in the real estate card and the corresponding amount is not returned to the individual.

In other words, in this case the individual may spend money on the revaluation but may not benefit from it.
