The number of notaries is increased - The changes in the law are ready. From 1 per 15,000 residents to 1 per 7,000
The Ministry of Justice, in cooperation with the National Chamber of Notaries, has drafted some amendments to the current law "On Notaries", which have been issued for public consultation.
Referring to the document, it is emphasized that through the draft act it is intended to clarify the rules related to the number of notaries, the filling of vacancies, the inspection of notaries, as well as the disciplinary measures of notaries, deputy notaries and cases of dismissal of members of the Disciplinary Board.
According to the Chamber's request, the ratio that determines the total number of notaries is changed from 1 notary for every 15,000 residents to 1 for 7,000 residents.
This report is based on the practices of other similar countries in the region or even beyond. The document states that from the professional activity it is noticed that this public service is not offered only to the resident population, defined as "resident" or "individual".
Notaries also serve foreign citizens, legal entities, independent professions, banks, state institutions, organizations, etc. In order to guarantee proper public access, it is necessary to constantly review the total number of notaries in relation to several factors.
With the changes in the law, every vacant position will be filled through competition, thus it will be guaranteed that the vacant position will be filled with candidates with more quality and ability to practice the profession.
Also, changes have been made in the draft in order to give notaries the opportunity to request the temporary suspension of the license for academic purposes, for a maximum period of up to 3 years.
