The government has launched the "Mountain Package" which aims to attract investments for the sustainable development of the economy in those mountain areas with special advantages for the purpose of economic recovery, promoting employment, improving living conditions and efficient use of natural resources. .

The draft law approved at the government meeting provides for the declaration of mountain areas with development priority as well as the development of state assets owned without title by private entities in these areas, in harmony with the rules and legislation for planning and development of the territory.

The draft in question gives the green light to the transfer of ownership through the sale with a symbolic fee of 1 euro of these state real estates, which turn out to be in the actual possession of non-owners.

In this case, non-owner possessors are those individuals who exercise continuous and uninterrupted possession for at least 10 years over state real estate, using it as if they were its owner.

For this, the subject presents supporting documentation, but the lack of documentation does not prevent the administrative procedure for recognizing him as a "non-owner possessor" and the subject's declaration is taken for granted as long as evidence to the contrary is not presented by third parties during the public display and procedures specified in this law.

Likewise, those natural persons who do not use the property, but prove their connection with the property, for which they have not been provided with a title, according to the legislation in force, and seek to develop it through an investment, will also be considered non-owner possessors.

After the entry into force of the decision of the Council of Ministers, which declares the development area, the subjects must submit a request to the local self-government unit for recognition as non-owners, accompanied by a survey plan of the owned surface, drawn up by an expert geodesist licensed.

And then the local institutions verify the request for its approval or not. In case of approval, the procedure passes to the Territorial Development Agency, to obtain the development permit. And finally, the purchase request is made to the responsible ministry and the sales contract is signed.

Entities, who benefit from the ownership of the surfaces according to this law and who realize the project and exercise the activity declared by them, benefit for a period of 10 years: exemption from the tax on the impact on the infrastructure; real estate tax exemption; exemption from VAT; exemption from income tax.
