New rules for airport areas - Priority, security. Administrative measures for offenders
The Council of Ministers defined the rules for the development of airport areas, regarding the impacts they may have on operational safety, the proposed constructions or the use of land in the protected areas of the airport and outside them.
The protected area of the airport, in the sense of this decision, means the territorial area, which lies in a radius of 15 km from the reference point of the airport. Meanwhile, airports that are used exclusively for military purposes will be exempted from the application of this decision.
According to the government's decision, permission for development or construction in the protected areas of the airport is obtained from the National Council of Territory and Water. Any facility or structure planned for construction or installation in the protected areas of the airport must receive, as the case may be, approval or consent from the Civil Aviation Authority, CAA. Objects, structures or installations will be notified to CAA regarding the height, coordinates and structure or type of construction.
Meanwhile, according to the decision, it is emphasized that the development, construction or use of real estate, within the protected area of the airport, for activities or activities, which may attract wildlife, will be notified to CAA for assessment. CAA provides the assessment within 10 days of making the request.
The CAA determines whether the objects or structures planned for construction or installation in the protected areas are dangerous objects due to their location, height or lack of marking or lighting. For this purpose, the development entities, which receive a positive evaluation from the CAA, must notify the latter about the start of the works and their completion.
The CAA expresses itself within 30 days from the day of making the request, and if the CAA does not express itself within 30 (thirty) days, the request is considered accepted and without objection, according to the determined decision.
It is also foreseen that administrative measures will be taken for the violation of the provisions related to the development or construction in the protected areas of the airport.
