ODIHR calls for transparency in party financing - Urgent opinion on the draft law: Clearer rules for donors

ODIHR has published an urgent interim opinion on the Albanian draft law on political party financing, where it positively assesses the aim of creating a more complete framework for transparency, financial reporting and control of political finances, but at the same time it also highlights a number of gaps that, according to the institution, need to be addressed to guarantee effective implementation of the law.
The document states that the draft law brings several important innovations, such as the creation of an electronic platform for real-time financial reporting, strengthening transparency obligations, stronger restrictions on funding sources and cash transactions, and expanding the supervisory powers of the Central Election Commission. The draft law also provides for more detailed rules for the distribution of public funds, including incentives related to gender equality and youth participation in politics.
According to the ODIHR, if implemented effectively, the law could contribute to the fight against corruption and create a more level playing field for political parties, but the report warns that several risks remain that could undermine the functioning of the system. One of the main concerns relates to indirect financing and the possibility of circumventing the rules through hidden donations or third-party funding.
In this context, the ODIHR recommends a ban on donations made in the name of other persons, the declaration of the profession and employer of donors, as well as transparency on the beneficial ownership of companies financing political parties. It also calls for clearer rules on loans to parties, in-kind contributions and the publication of financial reports.
The report also highlights the need for clearer harmonization between the draft law and the Electoral Code, to avoid overlaps and legal ambiguities, while emphasizing that the implementation of the reform will depend largely on the financial, human and investigative capacities of the CEC.
