"Changes in the law harm our independence" - Private executors:

A group of private bailiffs have opposed the changes that the Ministry of Justice has planned to make to the current law.

During the public consultation process, some bailiffs have expressed that the draft act will have a negative impact on the independence of private bailiffs, will violate the autonomy of independent bodies such as the Disciplinary Commission, and risks turning the entire disciplinary process into a control tool of the Ministry of Justice.

From this draft act, the Ministry of Justice has additional powers in terms of disciplinary proceedings against bailiffs who commit violations.

Specifically, the Minister of Justice will be given the right to take disciplinary measures directly, while the previous law intended that these sanctioning decisions be taken by an independent body, such as the Disciplinary Commission, to guarantee objectivity and to minimize political influences.

The law in force stipulates that the individual seeking to be licensed as a private bailiff must fulfill, among others, the condition of being in a full-time employment relationship with a bailiff or private enforcement office, as an assistant bailiff for a period of not less than 2 years, after completing the mandatory initial training. The proposed change aims to reduce this period of professional experience from 2 years to 1 year, jeopardizing according to them the quality of the corps of young executors.

Also, the private bailiffs have assessed that this draft law does not provide sufficient clarity on the terms and manner of submission of documentation and archive by the bailiff, which creates an unnecessary space for subjective interpretations and different applications.
