Beach allocation postponed until the end of June, government approves 2026

Exceptionally, for 2026, the deadline for concluding lease contracts for the use of the beach station will be within June. This is the determination made by the government decision, which charges the Coastal Agency and the local government with making the respective allocations. The granting of leases of beaches has often been a cause of clashes between beneficiaries and it seems that this pressure has caused their allocation not to be made before the summer holiday season begins.

ABOUT

SOME ADDITIONS TO DECISION NO.649, DATED 16.10.2024, OF THE COUNCIL OF MINISTERS, “ON THE APPROVAL OF THE REGULATION “ON THE CONDITIONS AND CRITERIA FOR THE EXERCISE OF THE ACTIVITY OF THE BEACH STATION””, AMENDED

In accordance with Article 100 of the Constitution and point 4, Article 64, of Law No. 93/2015, “On Tourism”, as amended, upon the proposal of the Minister of Tourism, Culture and Sports, the Council of Ministers

DECIDED:

1. In the regulation attached to decision no. 649, dated 16.10.2024, of the Council of Ministers, “On the approval of the regulation “On the conditions and criteria for exercising the activity of the beach station”, as amended, the following additions are made:

a) After point 5 of Article 14, point 5/1 is added, with the following content:

"5/1. Exceptionally, for the year 2026, the deadline for concluding lease contracts for the use of the beach station, provided for in point 5, article 4, of this regulation, will be within the month of June.".

b) In Article 5 of Annex I, “Model Contract for the Use of Beach Space”, attached to the regulation, points 3 and 4 are added, with the following content:

 "3. The Grantor, in cooperation with the local self-government unit, may propose amendments to this contract, in cases of changes in the capacity of the accommodation structure, the beach area or developments in the coastal area, only with the mutual consent of the parties.

4. For existing contracts concluded for the use of beach space, the changes provided for in point 3 of this article shall be carried out only with the mutual consent of the parties, through the signing of the amendment to the contract.”.

2. The ministry responsible for tourism, the National Coastal Agency and local self-government units are charged with the implementation of this decision.

      This decision enters into force upon publication in the "Official Gazette".
