Energy purchase and sale contract - Business organizations, letter to ERE: Proposals for production forecasting and imbalances
Four of the most important business organizations in the country have officially addressed the Energy Regulatory Authority with a letter, presenting concrete proposals for changes to the energy purchase contract between Private Producers and Free Market Suppliers.
The proposals of the Albanian Renewable Energy Association (AREA), the Foreign Investors Association (FIAA), the Italian Chamber of Commerce in Albania and Confindustria Albania, come after the draft contract proposed by the Free Market Supplier and issued for consultation by the ERE, while emphasizing that there are currently gaps in the contractual relations, which according to them create legal and financial uncertainty for energy producers.
One of the main requirements is that the contract also foresees the sending of information from producers on the hourly energy produced on day D+1, so that producers can create an accurate database as a basis for an analysis and forecast of production as accurately as possible. According to them, the forecast should be sent by October 30, which coincides with the end of the hydrological year, and not by August 1, which is the FTL proposal. It is also emphasized the lack of clear addressing of imbalances in the network during power outages, which lead to losses for producers. For this, it is required that the disbursement of payments for lost energy not remain outside the attention of the ERE.
According to FTL, the contract amendments are necessary due to developments in the energy market, problems encountered during the implementation of the current contract, as well as the need to adapt to industry best practices. The proposed amendments are also necessary due to the recommendations of the Supreme State Audit Office in the compliance and regularity audit report dated 31.07.2023, to improve the terms of contracts with Priority Energy Producers.
