Industry, new obligations for pollution - Monitoring of emissions of greenhouse

Operators of heavy industry, aircraft and shipping companies will have to draw up monitoring plans for greenhouse gas emissions and report the data to state institutions."

Some changes in the law "On Climate Change", issued for public consultation by the Ministry of Tourism and Environment, provide for changes in the procedures that these entities must follow for monitoring and reporting polluting gases in the air.

According to the law, the monitoring plan must contain the monitoring methodology, concrete measures for monitoring and reporting GHG emissions from the installation, as well as accompanying documentation, as appropriate. 

Obligations to perform monitoring and reporting include the release of Carbon Dioxide from installations such as: waste incineration, oil refining, coke production, production or processing of a variety of metals, lime, glass, etc. The obligation also includes the processing of ceramic products, the production of paper or the production of most organic chemicals.

The monitoring data reports, together with the verification report that will be performed by a second entity, must be submitted to the National Environment Agency.

The new law also provides for a review of the level of fines, in case of violations of these obligations, ranging from 2 - 4 million ALL.

The administrative measure increases to the extent of 2 percent of the value of the fine every day until the non-compliance is corrected. The same penalty levels will be for the aircraft operator and the shipping company.
