Businesses operating in the country must be more careful in their activities as the new Criminal Code released for public consultation targets any attempt at evasion or inaccuracy.

Specifically referring to the voluminous document, "the creation of fraudulent schemes related to Value Added Tax, which reduce the tax liability in order to increase its refundable credit value, through the issuance of falsified invoices, or manipulation of the accounting system, which has the effect of reducing the state budget, is punishable by imprisonment of 3-8 years."

On the other hand, evasion through uncompleted transactions constitutes a criminal offense. Specifically, "the presentation of false data through falsified invoices relating to uncompleted transactions, fraudulent agreements or conduct, or manipulation of the accounting system, made with the intention of committing tax evasion, is punishable by imprisonment of 4-9 years.

The draft also stipulates that violating the obligation to maintain tax data documentation by businesses is punishable by 1-5 years in prison.

Intentionally submitting forged or intentionally incomplete documents or requests to the tax authority to support the illegal return of previously paid tax obligations is punishable by a fine or imprisonment of up to 3 years.

Defacing distinctive signs placed by the tax administration for the blocking or suspension of commercial activity, or exercising commercial activity after notification of the tax administration's decision for its blocking or suspension, constitutes a criminal offense and is punishable by a fine or imprisonment of up to 2 years.

Voluntary failure to pay obligations based on their self-declaration, partially or fully, or within the deadline set in the relevant law, constitutes a criminal offense and is punishable by a fine or imprisonment of up to 1 year.

Interfering with the regular functioning of fiscal devices, electronic billing devices, with the aim of not fully recording data for the purpose of tax evasion, constitutes a criminal offense and is punishable by a fine or imprisonment of up to 2 years.

Likewise, creating plans, circumstances or finding collaborators to commit serious tax evasion is punishable by a fine or imprisonment of up to three years.
