March 31 is the deadline for employees with gross income over 1 thousand euros per month or annual income of 12 thousand euros per year, as well as for both employees, to complete the Individual Income Tax Declaration (DIVA) with the tax administration, for the fiscal year 2024.
But in addition to the obligation to declare, there are also benefits this year.
Specifically, according to the income tax law, individuals who pay tax on personal income from employment and business can deduct it from the tax base for the relevant tax period.
Article 22 of the law stipulates that "taxpayers shall deduct a compensation amount for each dependent child under 18 years of age who lives with the taxpayer in a joint family, of 48 thousand lek."
The deduction can only be claimed through the annual income declaration (DIVA). While point 2 of the same article clarifies that “A personal income tax payer with annual taxable income from employment and/or annual taxable income from business of less than 1.2 million lek may deduct, in addition to the individual amounts under point 1 of this article, current expenses for the education of children in his care, up to a maximum value of 100,000 lek.
The allowance for a dependent child and education expenses are claimed by the family member with the highest annual taxable income. According to the law, a personal income taxpayer with employment income, through a personal status declaration, may claim personal deductions from his payroll tax agent on a monthly basis.
The Minister of Finance is preparing the relevant guidance for new tax declarations and how deductions will be applied.
A person is required to file an annual personal tax return when their annual taxable income is more than 1.2 million lek of gross employment income, or more than 50 thousand lek of any other income not subject to final withholding tax.
