Purchasing goods, how will consumers be protected? - Draft law/ Administrative

Albanian consumers will be more protected when it comes to purchasing various products, having more rights in relation to merchants.

The government has submitted for public consultation the draft law "On Consumer Protection", which is in full compliance with European Union directives.

The fundamental aim of the draft law is to ensure a high level of protection for Albanian consumers, by establishing clear guarantees for contractual transparency, pre-contractual information and the right to withdrawal and new provisions for the redress and clarification of consumer rights before and after the conclusion of the contract, including mandatory information, the right of withdrawal and the limits of this right.

The draft law addresses the regulation of specific situations such as: non-conformity of goods, delay in delivery, passing of risk, environmental claims, psychological inducements on digital platforms (dark patterns), and the use of manipulative interfaces.

It also regulates the consumer's right to withdraw from the contract, guarantees transparency in information on prices and characteristics of products and services. Provisions are also foreseen for contracts for the sale of goods and for the supply of digital content and services, which also define the means for the right to repair, replacement, price reduction or termination of the contract.

The administrative measures imposed by the Consumer Protection Agency, which is the key institution for the implementation of this draft law, range from 3 thousand to 6 thousand euros, in case of complaints and claims, and the right to compensation is granted.

The expected effects of the draft law are positive and multifaceted. In the short term, increased transparency in contractual relations and improved commercial practices are expected. In the medium term, the draft law is expected to increase consumer confidence, strengthen their decision-making and promote fair competition in the market.

In the long term, provisions on sustainable consumption and the right to repair are expected to have an impact on reducing waste, extending the life cycle of products and meeting the objectives of EU environmental policies.
