Administration of collective housing – What innovations does the new law

The new law brings a mandatory and organized approach to the administration of buildings, putting an end to the situation where many buildings were not covered by any form of management. The main innovation is that every building with more than one owner must have an administrator, an individual or a company certified by the municipality, and a functional structure of co-ownership.

According to the law, now any shared space such as stairs, elevators, basements, facades or terraces will be registered as jointly owned property in the cadastral documentation, putting an end to abuses and different interpretations of ownership.

The law sets out the responsibilities of the administrator who will have a clear role and legal obligations, including:

• Maintenance and repairs;

• Cleaning and contracts with suppliers;

• Collection of monthly residents' quotas;

• Legal representation of the palace and annual reporting of expenses.

The contract with the administrator will have a minimum term of three years, to ensure stability and avoid frequent rotations for personal reasons.

The law also establishes the creation of a co-owners' assembly, with the power to decide by majority vote on important issues such as the budget, major works, or even the dismissal of the administrator in case of malfunction.

Also, for the first time, construction companies are legally obliged to administer the building until the final handover of the property and the issuance of the occupancy certificate. They must include in the sales contracts the deed of co-ownership and the administration regulations, documents that are registered in the Cadastre.

Another important element of the law is the role of municipalities, which will:

• Certify administrators;

• Supervise the administration process;

• Maintain and update the “condominium book”;

• They impose fines in case of violations that harm the collective livelihood.

All condominium data will be accessible through the e-Albania platform , increasing transparency and reducing bureaucracy.

This new law aims to strengthen urban coexistence, protect the value of common property, and ensure a better quality of life for citizens. It marks an important step towards the normalization of community life and the creation of a new culture of citizenship in collective buildings.
