Urban transport is exempt from the obligation for POS - Ministry of Finance: They are not obliged to be equipped with payment terminals
Operators providing urban public transport services will not be required to be equipped with POS/POI terminals for making electronic payments. The clarification comes from the Ministry of Finance, following a request submitted by the National Association of Urban Transport regarding the implementation of the obligation to equip urban buses with payment terminals.
In its official response, the Ministry of Finance argues that tax legislation provides for an exemption from the obligation to equip with POS/POI for entities that are exempt from the obligation to issue invoices. According to the law “On invoices and traffic monitoring systems”, the exempted activities also include the sale of tickets or coupons by the driver of a passenger transport vehicle on urban public transport lines.
The Ministry considers that, since urban transport operators issue and collect invoices for their services through tickets or passes given to passengers, they are also exempt from the obligation to have POS/POI terminals at every point of sale. This interpretation applies to bus operators operating within cities.
The debate over the installation of POS/POI terminals on public transport has intensified in recent weeks, following objections from the National Association of Urban Transport. Representatives of the sector argued that installing the devices on every bus would present technical difficulties and would entail additional costs, which they said could also be reflected in the price of the ticket.
The obligation to equip with POS terminals is part of the measures taken by the tax administration to promote the use of electronic payments and reduce the use of physical cash in the economy.
