Albania will introduce new rules for online platforms, increasing user protection and obligations for companies offering digital services. This is what the draft law on Digital Services foresees, which aligns Albanian legislation with the European Digital Services Act, known as the DSA.

The most important change relates to how online platforms will handle illegal content. For example, if a misleading ad, a counterfeit product, or a post that violates the law is published on a social network, such as Instagram, Facebook, and others, users will have clear mechanisms to report it, while platforms will be obliged to review it and take timely action.

The bill also requires more transparency from platforms. In practice, if a user sees a sponsored ad on social media, the platform must make it clear that it is an ad and why it was shown to that user. Companies will also have to explain more clearly how the algorithms that recommend videos, posts or products work.

Another change directly affects users. If a platform decides to delete a post or block an account, it will not be enough to simply remove the content. It must notify the user of the reasons for the decision and give them the opportunity to challenge it through appeal procedures.

The draft law also establishes stronger measures to protect minors online. For example, if a platform is used primarily by children or adolescents, the rules of use must be written in simple, understandable language for them.

Changes are also expected in e-commerce. Platforms that mediate online sales will be required to better verify merchants. This means that if a consumer buys a product from an online seller, it will be easier to identify who provided that product, reducing the risk of fraud or the sale of illegal products.

The draft law also creates a new authority, the Digital Services Coordinator, which will oversee the implementation of the law and cooperate with Albanian and European Union institutions.

However, it does not require platforms to pre-screen every post or comment that is published. They will not be required to conduct general monitoring, but will be required to act when they receive notifications of illegal content or when ordered to do so by competent authorities.
