Problems with the tendering procedures - PPA draws the attention of the institutions: Be careful with the criteria and the limit fund
The Public Procurement Agency has drawn the attention of institutions to the implementation of legal provisions in tendering procedures.
This department has completed the implementation of a verification plan for procurement procedures developed by various authorities during the period 2021-2024, while at the end of it a number of problems were found.
Based on this situation, through a letter addressed to all institutions, APP has brought to attention the legal provisions that must be implemented.
According to the letter, the contracting authorities must argue the technical specifications for the procurement object, while these specifications must not be drawn up with fixed parameters or a minimum interval.
This is because setting specifications in this way can direct bidders towards specific manufacturing brands, or can become an obstacle to participation.
Likewise, the authorities must document the calculation of the limit fund even in cases where it is based on the prices of previous contracts. This also applies in cases where the limit fund calculation is based on market testing.
For special qualification requirements, it is necessary to argue their necessity, while the number of employees and tools must be based on technical analysis based on the works that are expected to be performed.
In addition, license categories or their classification levels should not be requested, for which preventive works are not provided for.
The PPA also brings to attention a series of procedures that must be followed in the bid evaluation process, until the finalization of the announcement of the winner.
