Mining, rules for exploration and discovery change - Changes also for suspension of activity and environmental rehabilitation
Exploration permits will be granted through an open procedure for all areas for which there is no geological information or in those areas for which there is geological information, but there is interest in more detailed study and higher reliability regarding the data for the area.
This is one of the changes provided for in the law "On the mining sector", which, according to the accompanying report, aims to promote and encourage exploration activities to increase the potential of mineral reserves, especially those in short supply in the region and in the EU.
Another change concerns the definition of a time limit for the suspension of activity, due to various problems that mining companies may encounter. The draft law defines the right to request a suspension of up to 1 year, which is assessed by the responsible structure and approved by the ministry.
Changes are also foreseen in terms of the guarantee paid by companies that carry out mining activities for the environmental rehabilitation of the area.
According to the report, one of the problems encountered is the fact that the assessment of the value of the rehabilitation guarantee is carried out at the moment of obtaining the mining permit, but at the end of the permit's validity period, the real value of the rehabilitation is higher than the estimated one. For this reason, the draft law provides for the updating of this value, according to market prices.
The mining law also provides for the obligation of companies, upon the expiration of the permit, to rehabilitate the area in which they have carried out their activities, but does not specify a deadline for how long this rehabilitation must be carried out. For this reason, this draft law provides for a deadline of up to 18 months for the completion of the rehabilitation.
In the event that the mining permit holder has abandoned the permit area for 18 months, the deposited rehabilitation guarantee is transferred to the state.
