Fines of up to 3 thousand euros for donations and sponsorships - Obligation, publication of contracts and declaration in the Register
Any individual or company that makes various donations and sponsorships to public institutions or non-profit organizations, in areas such as art, sports, and culture, will face administrative measures in case of legal violations. The same goes for public institutions.
The new draft law on donations and sponsorships, submitted for public consultation, in its article 27, provides that "the failure to publish the donation agreement and sponsorship contract by the public body, as well as their accompanying reports, constitutes a violation under the information law and administrative sanctions of 50,000 to 100,000 thousand lek are applied."
The draft also specifies that "Concealing data in the National Registry of Donations and Sponsorships or inaccurate declaration of sponsors by beneficiary entities constitutes an administrative offense for a non-profit organization, sports organization, sports society, commercial entity in the field of film production and the audiovisual industry, as well as an individual in the field of culture, art, sports, and is punished with a fine by the General Directorate of Taxes from 100,000 - 200,000 thousand lekë."
Also, "the acceptance of illegal sponsorships by a non-profit organization, sports organization, sports society, commercial entity in the field of film production and the audiovisual industry, as well as an individual in the field of culture, art, from sponsors or donors who are prohibited by law from financing due to certain criteria, constitutes an administrative offense for the non-profit organization, sports organization, sports society, commercial entity in the field of film production and the audiovisual industry, as well as an individual in the field of culture, art, sport and is punishable by a fine from the tax authorities of 200,000 to 300,000 thousand lek.
Tax authorities do not apply the tax incentives for sponsors provided for in this law in the event of the above-mentioned administrative offenses being found.
Transparency in this regard is to guarantee that funds given or received are not linked to the phenomenon of money laundering.
