Digital violence against women, no longer unpunished - New law provides for

The Albanian Parliament has recently approved the law “on Prevention and Protection from Violence against Women and Domestic Violence”

For the first time, the law directly addresses digital violence and state intervention in the online environment. Online violence will no longer be treated as a social phenomenon or ethical problem, but as a legal violation with concrete consequences.

The law defines digital violence as any form of harassment, stalking, intimidation, publication of personal data or distribution of intimate materials without consent, carried out through social networks, applications and online platforms, that violates the dignity, safety and well-being of the victim.

Under the new provisions, the court can order the immediate ban on online communication, the closure or blocking of accounts, and the removal of abusive content within mandatory deadlines of 12 to 24 hours, depending on the risk and nature of the case. At the same time, the law provides for the preservation of digital evidence, such as messages, images, videos, or electronic data, which are now recognized as valid legal evidence.

Another important innovation is the establishment of legal liability for online platforms. If service providers do not comply with orders to remove or block abusive content, the Electronic and Postal Communications Authority can impose administrative fines ranging from 30 thousand to 500 thousand lek for every 24 hours of delay.

The law also provides for tracking mechanisms for perpetrators of digital violence, through cooperation with online platforms, the storage of technical data and, in cases where the elements of the criminal offense are met, the referral of the case for criminal investigation.

With this legal change, violence is no longer considered limited to physical spaces, but also in the virtual environment, where in recent years there has been a significant increase in cases of online harassment and stalking. Institutions aim through this law to limit abusive anonymity and create a rapid response mechanism for the protection of victims online.
