Solar power plants also on agricultural land - Draft law ready to pave the way for the construction of agrivoltaics
Construction of solar power plants within agricultural and forest lands, meadows and pastures that are state property will be a permitted activity.
The Ministry of Agriculture and Rural Development has issued for public consultation a draft law that paves the way for the leasing of these lands, as until now this activity was not allowed to be developed. In parallel, the law also provides for changes to the permission on state land for other technologies, which are: aquaponics (a combination of aquaculture and hydroponics), aeroponics and hydroponics.
According to the accompanying report, the changes arose as a need to harmonize legal provisions with the legislation on strategic investments. This is because, in the legislation on strategic investments, all entities that receive the status of strategic investor refer to sectoral legislation for the conclusion of authorizations and contracts. "In the case where the investor received the status of strategic investor for projects for the development of agricultural activity, as well as aquaponics on agricultural land, there was a legal obstacle to the conclusion of the contract by the institution of the Ministry of Rural Development and Local Development, because it conflicts with the sectoral legislation on the lease of state-owned land," the document states.
According to the Ministry of Agriculture and Rural Development, the use of these new technologies will bring increased investment and agricultural production as well as a new approach to agriculture in the country by utilizing not only agricultural land areas but also by developing plant cultivation above ground.
