Sponsors who contribute to the field of art, sports or culture will benefit from fiscal relief through a direct deduction of up to 30% from profit tax, both in the case of sponsorship in monetary value and in kind, guaranteeing a favorable fiscal treatment and concrete incentives for private sector engagement. Also, the income obtained from sponsorship is exempt from tax for the beneficiaries and does not affect their financial result for tax purposes.

The government has published for public consultation a completely new draft law on donations and sponsorships, with the aim of strengthening cultural identity, sustainable artistic and cultural development, promoting sports, territorial promotion, and increasing social cohesion, in line with the priorities of the National Development and Integration Strategy.

The draft law expands the areas for which donations and sponsorships are permitted and distinguishes between the two concepts. Specifically, a donation is considered the voluntary, unconditional and without any benefit transfer of financial contributions, movable or immovable property, provision of services or other forms of support for activities of public interest of public bodies. On the other hand, sponsorship is considered a contractual agreement by which the sponsor freely offers financial, material or other forms of support for an activity, activity or organization of public interest, in exchange for the right to promote and advertise its name, products or services.

Referring to the draft, for the first time it is envisaged that Albania will have a National Electronic Registry for Donations and Sponsorships. This registry will be accessible by the public at any time on the official website of the General Directorate of Taxes for data related to donations and sponsorships of public bodies. Any donation to public bodies over the value of 500,000 lek and all sponsorships will have to be registered in this registry.

Law enforcement bodies with competences in the fight against money laundering, corruption and terrorism will have unlimited access to the Register for data related to both public bodies and other entities benefiting from sponsorships, donors of public bodies and sponsors.

Since donations and sponsorships are considered high-risk activities for illegal influence, money laundering or illicit gain, the draft law has restricted certain categories of natural and legal persons from being donors and sponsors for public bodies (natural and legal persons convicted of offenses related to active or passive corruption, money laundering, financing of terrorism, illegal trafficking, tax evasion, non-payment of tax obligations, forgery of documents, or have activities that advertise gambling, tobacco, alcohol, etc.). The same criteria will also apply to sponsorships of a non-profit organization, sports organizations, sports associations, commercial entities in the field of film production and the audiovisual industry and individuals representing the Republic of Albania in international cultural, art, and sports activities.
