Harmonizing e-commerce laws across the region and aligning them with the European Union, with the aim of increasing or facilitating the free movement of goods and services across the region, is the main objective of the draft law submitted to the Assembly for the ratification of the 2024 decision of the Joint Committee of the Central European Free Trade Agreement (CEFTA), “On the Facilitation of Electronic Commerce”.

This draft law aims, among other things, to increase consumer protection from abuses that may occur from businesses that sell products online.

In the event of a dispute between a business that sells and a citizen who receives the service or product, they will have legislative support and the dispute can be resolved out of court.

According to the draft law, the consumer, regardless of having entered into a distance contractual relationship, will have a 14-day period to withdraw from a distance contract, without giving a reason and without incurring any other costs. So, if someone has made an online purchase, they have the right to cancel the order or return the product received within 14 days. The customer can be fully reimbursed within 14 days by the trader, but the product must be in good condition when returned.

If the product is lost or damaged during transportation provided by the merchant, the latter will be responsible, but if the carrier was provided by the consumer to transport the goods and was not provided by the merchant, then the citizen will be responsible.

The business must deliver the goods, transferring physical possession or control of the goods to the consumer without delay, within 30 days of placing the order, except in cases where the parties have agreed to a different deadline.

If the goods are not delivered within this period, if circumstances permit, delivery may be postponed for an additional period. If the goods are still not delivered, the consumer has the right to cancel the order and the trader shall reimburse him for the amount paid.
