Public contracts, 20 operators excluded - PPA: 50% of them submitted false data in tenders
20 economic operators were excluded from the right to win public contracts during 2024. According to data from the Public Procurement Agency, 10 of them were excluded due to misinformation and submission of documents containing false data in tenders. While, the other 10 operators were excluded due to failure to fulfill contractual obligations.
Their exclusion came after an administrative investigation conducted by the Public Procurement Agency, based on complaints received by this department from other economic operators, contracting authorities or the Supreme State Audit Office.
In total, during the past year, a total of 64 complaints were filed, but while 20 of them were excluded from the right to win public contracts, the decision for the rest is different. Thus, for 29 economic operators, the PPA did not initiate administrative proceedings, as the complaint filed by the proposers was considered with insufficient documentation and unsubstantiated to initiate administrative proceedings, or after verifications carried out, it resulted that the conditions for initiating administrative proceedings, according to legal provisions, were not met.
In 7 cases, the administrative proceeding was suspended due to the legal process initiated by the economic operators, while in 4 others, non-exclusion was decided.
Meanwhile, 4 of the complaints are still in process and there is no final decision on whether or not to exclude the operators from the right to win public contracts.
